Which one applies to you is not a choice — it is determined by whether your short-term debts are settled. The assessment establishes that before you pay anything.

Your short-term debts are settled and you just need the flag removed.

You qualify if

  • Every short-term account in your debt review plan is paid up
  • A home loan may still be outstanding — it does not disqualify you
  • No court application is required

The fee covers

  • Form 19 clearance certificate issued
  • All four credit bureaus notified (TransUnion, Experian, XDS, VCCB)
  • National Credit Regulator register updated
  • Written confirmation once every bureau has cleared the flag

Court-Led Removal

Section 87 / 165

Typically 2 to 3 months

You still owe money but can now afford your original instalments.

You qualify if

  • You are no longer over-indebted and can prove it
  • Debts remain outstanding on your plan, or a court order was granted
  • A Magistrate's Court application is required

The fee covers

  • Attorney engagement and court appearance on your behalf
  • Affidavits, creditor notices and supporting documents prepared
  • Court order obtained and served on creditors
  • Bureau and NCR updates once the order is granted

What Moves a Quote Above the "From" Price

"From" is not a bait price. These are the specific things that add work to a case, and you get an exact figure in writing before anything starts.

Number of credit providers

More creditors means more notices, more certificates of balance and more follow-up.

Whether a court order exists

An existing Section 87 order must be rescinded under Section 165, which is a separate application.

Marital regime

Spouses married in community of property share one estate and must apply jointly.

Your debt counsellor's status

If your original counsellor has closed down or is unresponsive, the case must first be transferred.

Court roll availability

Timeframes on the court route depend on how busy your local Magistrate's Court is.

Before You Pay Anyone Else

A credit bureau may not lawfully remove a debt review flag without either a Form 19 clearance certificate from an NCR-registered debt counsellor, or a court order. There is no third way.

  • Anyone promising removal in 24 hours, without a court order or Form 19, cannot deliver it lawfully.
  • Anyone asking for full payment before telling you which route applies has not assessed your case.
  • Check any provider's NCR registration number on ncr.org.za before you pay.

Staying under debt review means continuing to pay debt counselling fees and restructured instalments, and being unable to access credit. If you qualify to exit, removal is a once-off cost against an ongoing one — but it is only worth it if you can genuinely afford your original instalments, which is exactly what the assessment checks.

No. A credit bureau may not lawfully remove a debt review flag without either a Form 19 clearance certificate from a registered debt counsellor or a court order. Any company promising same-day removal without one of those is operating outside the National Credit Act.
