Debt Review Removal — Tembisa | Gauteng

Tembisa borders Kempton Park, a short trip from our Rhodesfield office. We help Tembisa residents who have paid off their accounts but are still flagged, and those whose income has improved enough to leave debt review early.

Warning

Debt review removal is not an administrative update. A credit bureau may only remove the flag on a Section 71 clearance certificate or a court order. Anyone offering to "remove the flag overnight" without one of those is operating outside the National Credit Act.

Paid off your store accounts but still can't get credit?

This is the most common Tembisa case we see. Someone went under debt review with clothing, furniture and cellphone accounts and a personal loan or two, paid them all off over the years — and is still declined everywhere, because nobody issued the clearance certificate.

The flag stays until a registered debt counsellor collects a paid-up letter for each account and issues a Section 71 clearance certificate (Form 19). We do that for you, from R2,900, typically within 14 to 21 working days. If your old counsellor cannot be reached, we take over the file through the National Credit Regulator.

Loans that are not part of your debt review

Debt review only covers credit agreements with registered credit providers. Money borrowed from an unregistered lender (a mashonisa), a stokvel or family is not on your plan and does not affect your clearance certificate. If an unregistered lender is holding your bank card or ID as security, that is unlawful, and we can tell you where to report it.

Leaving early through the court

If you still owe money but now earn enough to pay your original instalments — a permanent post after years of contract work, say — our panel attorney can apply to court to end the debt review. From R6,500, typically 2 to 3 months. You do not have to go to court.

We check affordability first. Leaving debt review removes the protection against legal action, so we only recommend it if you can genuinely keep up.

Seeing us in person

Our office at 9 Spoorlyn Rd, Rhodesfield, Kempton Park is a short taxi or train ride from Tembisa, next to the Rhodesfield Gautrain station. Most clients send documents by WhatsApp (076 982 2112) and never need to come in.

Is this a scam? How to tell a lawful removal

  • Only a Section 71 clearance certificate from a registered debt counsellor, or a court order, can remove a debt review flag. A promise of removal in days without either is not lawful.
  • You should get the exact fee in writing after your assessment and approve it before any work starts.
  • The National Credit Regulator does not process removals over WhatsApp. We use WhatsApp to collect documents and answer questions; the removal itself is a certificate sent to the bureaus or a court order.
  • Check any provider's registration before paying. Ours is NCRDC2403 — search it on www.ncr.org.za.

Frequently Asked Questions in Tembisa

Because the flag is only removed when a debt counsellor issues a clearance certificate and sends it to the credit bureaus. Paying the last instalment does not do this automatically. We can issue it once we have a paid-up letter for every account.

Usually the Tembisa or Kempton Park Magistrate's Court, depending on your section and on which court granted your original order. We confirm this before filing.

A clearance certificate is typically issued within 14 to 21 working days. A court-led removal typically takes 2 to 3 months.

No. Loans from unregistered lenders are not part of debt review. Only the accounts on your debt review plan need to be settled.

A Section 165 rescission is brought in the court that granted the original debt review order, not the court nearest your new home. If your order came from another town's court, that is where our attorney files — you do not need to attend either way. If no order was ever granted, a Section 87 application goes to the court with jurisdiction over where you live now.

Search NCRDC2403 on the National Credit Regulator's website (www.ncr.org.za) under Registrants, then Debt Counsellors. Our only official channels are debt365.co.za, 087 012 6412 and WhatsApp 076 982 2112. Anyone else promising to 'remove' your flag for a fee is not us.
